Interviewer: As a domestic violence attorney, what are some common misconceptions that you see people have about domestic violence cases?

In Westchester County, There Is a Special Unit Assigned to Prosecute Domestic Violence Crimes

Michael Kramer: Well the common misconception is that they’ll be handled like any other violation of the criminal law. That’s a misconception because they’re treated separately by the district attorney’s office. I’m specifically referring to the district attorney’s office in Westchester County.

They have formed a separate unit, a domestic violence unit or branch, and all domestic violence cases are referred to that branch. They have prosecutors assigned to that branch who only handle those types of cases. Those prosecutors do not treat violations of the law as district attorneys in other branches. They take further safeguards and they treat it much differently. It is incredibly important to have a domestic violence attorney protecting your rights when facing these special prosecutors.

Interviewer: When you’re working with a client in a case like this, what are some of the common mistakes that you see them make?

Many Defendants Are Unaware of the Gravity of a Domestic Violence Charge

Michael Kramer: Well they don’t make any mistakes if the case is handled correctly by a domestic violence lawyer who knows what he’s doing with domestic violence incidents. It’s not a mistake per se, but a lot of defendants come in to see me and have misconceptions in that they feel that it’s just a typical fight between myself and my wife.

My wife has forgiven me, let’s forgive and forget and let’s go back to where we were beforehand. Unfortunately, the system does not treat it that way. Once police are called you now have law enforcement involved and subsequently the criminal justice system coming between you and your wife. This does not always work well to facilitate continuing your relationship, and often acts as an obstruction to your relationship.

It’s not a mistake a defendant makes, but it’s a misconception that they’re going to be able to continue on as if nothing happened. This is not the case. There will be consequences but a domestic violence attorney can help to minimize their impact on your life.
