Located in Westchester County, the Yonkers City Court handles criminal, civil and traffic cases. Yonkers is the most populous City in Westchester County and the fourth most populous city in New York State. Combine this with its jurisdiction which covers several parkways, and the result is an extremely high volume of criminal and traffic cases including DWI.

Handling this volume of cases requires six judges who divide the Yonkers Court into various sub‑parts for the sake of efficiency. Traffic Court, Criminal Court, Drug Court, Domestic Violence Court, Landlord and Tenant Court and Small Claims Court are examples.

Generally, the Yonkers Police Department enforces the traffic laws in the local streets of Yonkers. The local parkways including Bronx River, Saw Mill River and Cross County, that pass through Yonkers, are patrolled by the Westchester County Police. Interstate 87 which also passes through Yonkers is covered by the New York State Police.

THE INSIDE STORY:

The huge volume of criminal and traffic cases brought in Yonkers City Court, can result in both advantages and disadvantages to a person charged with a criminal or traffic case.

The disadvantage mainly centers around the time delay involved in resolving a criminal case, especially if a trial is desired. In some cases, it has been my experience, requesting a trial can result in a delay of over two years to resolve.

On the other hand, the volume of criminal cases can result in achieving a disposition which is much more beneficial than can be achieved in other local courts in Westchester County as there is a subtle pressure on both the judges and District Attorney’s Office to dispose of cases as expeditiously as possible.

Traffic cases do not suffer from the disadvantageous of long delays. The Yonkers City Court is quite efficient in scheduling and disposing of traffic cases in a timely fashion.

MY SUGGESTION:

For the past 30 years, I have handled criminal cases including DWI and traffic cases in the Yonkers City on a regular basis. I am therefore familiar with the judges, court personal and members of the District Attorney’s Office and have learned how best to maneuver such cases through the Yonkers Court system.

If you have a criminal case including a DWI in Yonkers, the Court will require representation by an attorney. If you have a traffic case, the question arises as to whether it is worth retaining an attorney. The answer is based on common sense which tells us that an attorney who regularly appears in the Yonkers City Court, and who knows and has developed relationships with the court personnel is gong to achieve a better result than a motorist appearing for the first time.
