Interviewer: What about programs like counseling and anger management? Do those come into play during the domestic violence case and are those helpful to recommend, as a domestic violence attorney?

Michael Kramer: They are helpful in two ways. They’re helpful in painting a favorable picture of a defendant when dealing with the district attorney and trying to negotiate a plea bargain. It is beneficial for a defendant to voluntarily undertake anger management programs and it certainly helps when the individual is doing well in that programs.

It Can Be of Great Benefit for Domestic Violence Attorneys to Direct Clients to Voluntarily Seek Treatment and Doing So May Mitigate the Potential Consequences of a Domestic Violence Charge

When the reports come in that he is in control of his emotions, it helps with the disposition of the case and it also helps after conviction with regard to the appropriate sentence to impose. It helps avoiding jail time, it helps sometimes avoiding probation or it becomes a condition of probation.

Those programs are readily available in Westchester County and depending upon the circumstance they are heavily utilized and highly recommended by domestic violence attorneys. On the other hand, it used to be rather automatic. Once you’re charged with a domestic violence incident, you would automatically have an order of protection imposed and you’re required to go into an anger management programs. This was required whether you’re as innocent or as guilty as can be.

This created another hardship on an individual, just by virtue of the fact that they’re charged with no proof offered. The domestic violence court has loosened up in that regard a bit. In that, the judge will evaluate the particular case and determine whether enrollment in a program, while the case is pending, should be a condition imposed or not. It’s not automatic as it used to be and should be discussed as an option with your domestic violence attorney.
