Interviewer: If convicted, is the probation supervised or unsupervised probation?

Michael Kramer: Probation is supervised. A condition discharge is unsupervised.

Interviewer: If someone faces the probation, are they visiting with a probation officer once a month? What do they do?

Michael Kramer: It may start, depending upon the facts, depending on the person’s background, it may be once a week, it may be once every two weeks, it may be once a month. It may go down to from physically visiting a probation officer to calling in to the probation department or filling out a form if you’ve not been in any further trouble.

It depends upon your relationship to the particular probation officer assigned to your matter and how things develop from there. What their particular policy is with regard to these matters.

Michael Kramer: Yes, there’s always a drug testing provision as a condition of probation, as well as many other onerous conditions.

Michael Kramer: I have a feel for people. I have a feel for people and I have a feel for relationships. I found through experience that I can soothe the way and repair all wounds (hurt feelings). Hopefully, there’s a chance of the parties getting together and a chance of resolving the matter in a way that will not cause lasting and permanent injury to the relationship.

Those various alternatives should be explored. I’m not the type of attorney that’s so overly adversarial that I cause feelings to explode, to exacerbate and to cause lasting damage to relationships. That’s the opposite of what an attorney should do in these types of cases.

A low keyed, reasonable approach helps others gain faith in your abilities. A judge is gaining faith in the particular attorney, a prosecutor gains faith in the view of the particular attorney. A good choice is an attorney who has dealt with the prosecutor’s office over the years and developed a good relationship with them. So much so, that when he makes representations on behalf of his client, the prosecutors will believe that he knows what he is talking about and he is not trying to pull the wool over their eyes.

Michael Kramer: Just a word of caution for all in relationships. Don’t fight and don’t call the police out of anger or retribution. Call when you have reason to, otherwise, you’ve got trouble.

It Is Important to Understand the Ramifications of Domestic Violence Accusations

Interviewer: What emotions are your clients commonly experiencing?

Michael Kramer: They are angry, scared, disgusted; all different emotions. A lot of them don’t realize how badly it might affect arelationship. Most of them think that, “Oh, it’s just an incident that happened. My wife is going to forgive me and it’s going to be over. Nothing is going to be made of this.”

This is how they feel until you inform them of how the criminal justice system treats these types of incidents, and how the district attorney’s office and the judges actually come between both of you in the relationship. It’s not a pleasant thing to go through especially if your objective is to get it over with as quickly as possible, and hopefully have it result in a form of dismissal.

That I will work the case through the criminal justice system in a manner that will make them proud. That we will work to find a resolution that will not cause permanent damage to the relationship and will not result in a criminal record. That’s my objective and I usually can achieve that objective.
