Fees for Three Years after Conviction

On November 18, 2004 New York State instituted a mandatory responsibility assessment program. The “assessment” is an annual amount that a driver must pay to New York State for three years upon conviction for certain traffic offenses.

To avoid license suspension for non-alcohol related traffic infractions such as speeding, a driver must pay a minimum annual fee of $100 for three years ($300 total) when he accumulates six points in an l8 month period. This also applies to out-of-state drivers. For each additional point beyond six, a driver must pay an annual fee of $25 per point.

A $450 Example

Suppose a driver is issued a ticket for traveling 90 mph in a 55 mph speed zone. After receiving the ticket, the driver pleads guilty. The Court imposes a fine which the driver pays. Soon after, the driver receives a notification in the mail from the DMV that he/she owes the DMV an additional $450.

The driver pled guilty to an 8 point speed.

  • The total assessment for the first 6 points is $300.
  • Each point over 6 points is $75. That is an additional $150.
  • The total assessment to the NY State DMV comes to $450.

The driver must also pay the court for the original ticket. If he/she fails to pay, their license will be suspended. Additionally, insurance premiums can be increased because of the plea to the high speed.
