Misdemeanor Offenses Are Handled in Criminal Court, Not in Traffic Court

Michael Kramer: Then they’re not only facing a traffic violation for the reason the police officer pulled them over but they’re now facing a misdemeanor charge for driving on a suspended or revoked license. This would bring the case to the criminal court and not the traffic court. Once you’re charged with a misdemeanor, it’s no longer a traffic matter and it’s now handled by the district attorney’s office, not a town prosecutor.

How Long Do Points Remain on Your License?

Interviewer: How long do the points stay on someone’s license?

The Department of Motor Vehicles Has an 18-Month Look back Period

Michael Kramer: With regard to the Department of Motor Vehicles, they only look within an 18 month period from the date you received the ticket. If, for example, you have 4 points on your license and you get another ticket within 19 months. That 4 point violation then it would not be counted against you by the Department of Motor Vehicles for the purposes of assessment of fees and license revocations.

If it was within an 18 month period that you got that second ticket, it would be counted. With the Department of Motor Vehicles, you just have to be concerned with an 18 month period. For insurance purposes, insurance companies sometimes look for any excuse to up the rates and most of them look as far back a 36 month period in deciding whether to assess you increased fees.
