Q: Once issued a traffic ticket, what are my choices?

  • You have 3 choices.
  • Ask for and participate in a trial if you have a credible defense.
  • Strike a plea bargain with the prosecuting attorney.
  • Plead guilty.

Q: Do I need an attorney?

  • It depends on how important it is to obtain a favorable resolution of your ticket.
  • You are not expected to be familiar with traffic court procedures.
  • Experience is what I offer, having handled thousands of traffic tickets over 30 years of legal practice, in every traffic court in Westchester and Putnam Counties, including White Plains, Yonkers, Harrison, Bedford, New Rochelle, and Greenburgh.

Q: What can you expect me to achieve?

  • My goal is to obtain a dismissal or reduction of your ticket or tickets to one that will have the least impact on your driver’s license.
  • If a traffic trial is necessary, I will prepare and conduct a trial in a manner that will give you the best chance of success.

Q: What if I already pled guilty and have a change of mind?

  • Under those circumstances it is possible to file a motion with the court to vacate your guilty plea and reinstate your not guilty plea.
  • Once that is accomplished, I will go to court and dispose of your ticket as I would
    have if you had never pled guilty.

Q: What about expenses?

  • Many people are hesitant to hire a traffic lawyer because they are worried about expense.
  • They worry that they have to pay a lawyer by the hour and therefore the cost is unpredictable at the onset of the proceedings.
  • Michael Kramer does not use this method. I charge a flat fee. You know exactly what it will cost prior to entering into our agreement.

Q: Will my insurance rates go up if I get a speeding ticket in White Plains, New York?

A speeding ticket, like any other traffic violation, will be reported automatically on your New York driving record. If you are insured in White Plains, certain traffic violations can affect your insurance rates. Under New York insurance law, speed violations of 15 mph or less over the limit will not affect your insurance rates. In addition, having one other traffic violation should not affect your insurance rates. However, it is important for drivers to be aware of the fact that insurance companies might not always follow the letter of the law. It is a much safer plan to keep your driving record as clean as possible. The best way to keep your insurance rates down once you receive a violation is to get a skilled traffic ticket attorney on your side.

Your insurance policy should include what is called a merit rating plan, which can give you more information. If you are an out-of-state driver who is ticketed in the state of New York, the answer is a bit less clear. New York State reports most types of traffic violations to the Drivers’ License Compact. A reported violation in New York can affect your insurance rates back in your home state, even if the type of violation in question would not affect your insurance in the state of New York.

Not every traffic violation in New York will affect your out-of-state insurance rates or driving record. New York tickets are commonly reported on driving records for several states, however, including New Jersey, Ohio, Florida, North Carolina, Connecticut, and Massachusetts. New York also reports the traffic violations of Quebec and Ontario drivers directly to those provinces. For New York drivers who receive out-of-state traffic tickets, those generally will not affect your driving record. However, tickets from Quebec and Ontario could affect your driving record in the state of New York. There is always a possibility that your insurance company will be alerted of an out-of-state violation. If this happens, your rates will likely go up and you will want to consult a traffic ticket attorney.

When Traffic Ticket Attorney, Michael Kramer, negotiates a plea bargain, he does his absolute best to minimize the impact a traffic violation will have on your diving record and insurance rates. He will work hard to get you a reduction from your original charge to a non-moving violation that carries no points on your driver’s license and does not affect your insurance rates. If that is not possible, there is a particular two-point violation that does not affect drivers’ insurance rates, and he can try to negotiate for that. If you are an out-of-state driver, he may ask for a reduction to a violation that has points in New York but does not in your home state.
