Interviewer: Why do you choose to handle domestic violence cases?

Michael Kramer: Domestic violence cases are a subcategory of practicing criminal law. Basically they involve violations of the law involving people who are related to each other, either by blood or by marriage or by friendship.

For example, an assault can be considered a domestic violence case if it’s between boyfriend, girlfriend, husband and wife, but an assault is an assault. It’s the same elements of proof so it’s basically a subcategory of criminal law. Any lawyer who specializes in criminal law certainly has handled domestic violence cases and may even end up considered a domestic violence attorney.

Domestic Violence Cases Receive More Publicity Now than They Did in Years Past

Interviewer: Have you seen an increase in domestic violence incidents over the years?

Michael Kramer: There has been an increase in public awareness, as domestic violence incidents are more and more publicized. I’m sure many people have read terrible incidents where there were orders of protection issued for a husband to stay away from a wife or for a boyfriend to stay away from a girlfriend. He ignores that order and the advice of his domestic violence attorney, and with terrible results, sometimes even death.

Police Are Now Required to Make an Arrest Almost Any Time They Are Called to the Scene of Domestic Violence; This Adds to the Volume of Arrests

The legislators respond to that and they pass laws to offer more protection to victims. New laws now require police officers to, when they’re called in to investigate domestic violence incidents, almost in all cases make an arrest. That adds to the volume of domestic violence cases and adds to the need for domestic violence attorneys in Westchester County.

Is Domestic Violence Prevalent among a Certain Demographic? Any Two People in a Relation Can Have an Incident of Domestic Violence

Interviewer: Is there a typical age for the accused or for the victim?

Michael Kramer: I don’t believe that I see one age group more predominately as opposed to another. I’ve seen 30, 40 and 50 year old couples have disputes resulting in domestic violence cases, as well as boyfriend, girlfriend in their early 20′s. Mother and son violent altercations are also classified as domestic violence. There really is no particular age group prone to domestic violence.

What Evidence Is Required to Prosecute a Domestic Violence Case in Westchester County?

Interviewer: What evidence is needed in order to prosecute a domestic violence case?

Michael Kramer: The same evidence that would be necessary in proving any other type of crime. An assault for example, a criminal mischief for example, a weapons charge; it’s just a different complainant. A complainant that you are related to, in the ways that I previously mentioned. Your domestic violence attorney can access the evidence against you through the discovery process.
