Is It Possible to Transfer Your Probation to another State?Interviewer: Now, we touched on this as far as you’re not leaving the county and move or going into another city, but what if it comes down to I’m actually been transferred from my job? Who do I need to get permission from or who does my attorney help me get permission to move to that other state and will my probation transfer there?

The Level of Your Offense May Determine Whether or Not You Can Transfer Your Probation

Mike Kramer: Probation transfers can be issued under certain circumstances. It depends upon the new state and whether they’re willing to accept you on probation. Each state is different by in law, do they usually will not accept you on lower forms of misdemeanor probation. If you’re on felony probation, they probably will accept you.

If Your New Home State Will Not Accept Your Probation, Your Probation Officer May Apply to Terminate Your Probation

For example, if you’re given the misdemeanor probation of three years and you’ve served a year or a year and a half and you’re ready to move, you have to ask permission of the probation officer to do that. If the state that you intend to move to will not accept you on probation, then the probation officer has to file a request from the sentencing judge to discharge you from probation so that you can move and start the new job.

The Judge May Not Always Grant the Early Probation Release

If the judge doesn’t, then you’re still on probation but living out of state, it presents a real problem with regard to reporting requirements. There are certain probations that actually can prevent you from moving out of state to accept the job. It depends on the circumstances but it does present an obstacle being on probation.
