Michael Kramer, Attorney at law

Your First Step If You Receive A Yonkers Speeding Or Other Traffic Ticket

Your first consideration should be whether you want to be represented by a Yonkers Speeding Ticket Lawyer. If you decide to use my services we become a team and you will always have someone on your side working for your best interests. I will ask you to fill out Part B (not guilty) on your ticket and forward the ticket to me. I will then forward it to the court along with a letter advising the court that you have an attorney and further requesting that the court advise me of a conference date in the future.

How The Majority Of Yonkers Tickets Are Resolved

The overwhelming majority of traffic tickets in the Yonkers Court are resolved by a plea bargain. This usually occurs at a pre-trial conference in which the objective is to achieve a substantial reduction in the points assessed against your license and in some cases if grounds exist, a complete dismissal.

The Advantages Of Hiring A Yonkers Speeding Ticket Lawyer

The main advantage is “peace of mind”. Once I enter an appearance in your case, the case becomes my responsibility; you no longer have to worry about it. I keep track of all court dates and I go to court for you to achieve the best disposition possible in most cases better than you could achieve if you go alone. If I represent you, you do not have to appear unless we decide a trial is the best option.

The Disadvantages Of Hiring A Yonkers Speeding Ticket Lawyer

The only disadvantage to you is cost. There is of course, a fee for legal services. I assure you my fees are extremely reasonable for the service performed. There is no cost for an initial consultation.

Why You Need A Traffic Attorney And Should Not Represent Myself?

You can represent yourself but why would you? It is too important not to leave it to an expert who has practiced in this area of law for over 30 years. I have developed a relationship with the prosecutor, judges and court personnel which can only benefit my clients. Your driving record is too important to jeopardize. Increased insurance rates, DMV fees and possible license suspension are all consequences which can result if you do not achieve a proper disposition of your ticket.

For example, in many cases, I can achieve a plea bargain in which your speeding ticket or any moving violation is reduced to a parking ticket with no points on your license, and will not be recorded against your license.

Types Of Speeding Laws In Yonkers

In New York, there are two types of speeding laws that govern how speeding infractions and violations are treated. The two types of speeding laws are absolute speeding limits and basic speeding law.

 Basic Speeding Law

Basic speeding law in New York states that a driver is prohibited from driving at a speed that is faster than is safe or prudent under the present conditions, despite the posted speed limit on the road. Drivers should always drive at a safe speed even if that means that they have to drive slower due to the weather or other circumstances that may be grounds for safety. For instance, if the present condition of the road is wet and slippery due to heavy rain, the driver is expected to practice safe driving. He or she should refrain from driving at the speed limit if the limit is not a safe velocity for drivers during a wet and slippery road condition. For example, if the speed limit on the road that you are driving on is posted at 55 miles per hour, and it is raining heavily with low visibility, it is expected that you drive at a reasonable velocity under 55 miles per hour.

If you have been pulled over for breaking a basic speeding law, it is recommended that you talk to an attorney with Yonkers criminal court experience. The penalties for breaking a basic speeding law ranges between $45 to $100 in fines. You can also be given up to 15 days in jail, depending on how serious the violation. An attorney skilled in the Yonkers criminal court system can help lessen the penalties or even get them dismissed.

Absolute Speed Limits

The majority of people, especially drivers, are more familiar with the concept of absolute speeding limits. Whether or not you are aware that it is more formally called absolute speeding limits, absolute speeding limits are the road speed limits that are set by the New York State Department of Transportation. In other words, they are the speed limits that you have to abide by when driving. For example, if the posted speed limit or sign on the side of the road says that it is 35 miles per hour, you cannot drive faster than 35 miles per hour. If you drive faster than the posted speed limit, you have violated the law, and you can get pulled over for speeding.

If you get pulled over for speeding, the police officer will most likely give you a speeding ticket. Speeding tickets can be steep for absolute speeding limit violations. A driver can incur a fine between $45 to $600 and/or up to 30 days in jail. The amount of the fine and jail time will depend on how fast a driver was going over the limit and other circumstances. Moreover, if you are caught speeding in a school zone, the fines can be up to $1,200 with the possibility of up to 30 days in jail.

If you have been caught speeding, it is expedient to seek the legal advice of an attorney who is knowledgeable in the Yonkers criminal court system.
